WAIVER AND RELEASE

PLEASE REVIEW CAREFULLY BEFORE PURCHASE

Kahou Farm Corp, located at 5162 township road 295A, water valley, T0M 2E0, (“Kahou Farm”) is a farm incorporated under the laws of Alberta, Canada. 

Fallentimber Meadery Limited, is a Meadery located at 5543 Township Rd 302, Water Valley, AB T0M 2E0 (“Fallentimber”). 

The Water Valley Community Association is located at Box 233 Water Valley, AB T0M 2E0 (“Water Valley Community”).

Kahou Farm, Fallentimber, Watery Valley Community are collectively organizing a festival called The Water Valley Arts & Music Festival (“Festival”). I understand that prior to my attendance and participation at the Festival, I am required to carefully read and agree to the release herein and assume sole responsibility for all risks associated with my attendance and participation at the Festival. By purchasing a ticket to the Festival, I agree to all terms herein.

Collectively, any reference herein to Kahou Farm, Fallentimber, Watery Valley Community includes its owners , directors, officers, core group, teachers,  members, instructors, agents, artist, volunteers, employees, organizers, affiliates, sponsors, participants, and other attendees (the “Released Parties”).

I, for myself, my heirs, executors, administrators and assigns, hereby agree to release, waive all claims and forever discharge the Released Parties from any claims, actions, expenses, liability, costs, or demands in respect of death, injury, loss or damage, of every nature, to my person (physical, emotional and mental) or property, wherever or whenever caused (including without limitation, any duty of care owed to me under the Occupiers’ Liability Act, Alberta), and including, without limitation, the negligence of one or more of the Released Parties, arising out of or in connection with my attendance to Kahou Farm, Fallentimber, Water Valley Community, either for the purpose of leisure or work, camping, retreats, festivals, and use of facilities of at any time and wherever held and more specifically, my attendance related to the Festival.

By purchasing a ticket to the Festival, I fully agree to this WAIVER AND RELEASE and I acknowledge that I am over the age of 18 and acknowledge that my attendance and participation in the Festival involves certain inherent risks, including but not limited to personal injury, illness, death, property damage, or loss arising from activities such as dancing, crowd movement, loud music, weather conditions, food or beverage consumption, or other unforeseen circumstances. 

I understand that any attendance, either for leisure, volunteering or work-related activities of Kahou Farm, Fallentimber, Watery Valley Community, that I will be participating in, and the equipment involved in these activities may have some inherent risks associated with them. I knowingly and voluntarily assume the risks of engaging in these activities. I will be completely responsible for my own well-being, when attending the farm, and will conduct myself appropriately and will fully waive any claims towards the Released Parties.

In consideration of being permitted to attend and participate in the Festival, I hereby release, waive, discharge, and agree not to sue the Released Parties from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or illness, including death, that may be sustained by me or my property while attending or participating in the Festival, whether caused by the negligence of the Released Parties or otherwise.

I also acknowledge that it is my responsibility to be aware of the risk associated with the activities and to safeguard my person by ensuring that I am physically, emotionally, and mentally capable of participating in the activities and have no prior injuries or conditions that may result in further injuries or instability. I will also exercise safety in respect of the appropriate activities and the equipment associated with such activities. I will not participate in any activities if they are beyond my capabilities, whether it be physical, mental, or otherwise.

I further confirm that I will take full responsibility for any minors in my care that will attend Kahou Farm, Fallentimber, Watery Valley Community and I waive all claims against the Released Parties on behalf of any minors in my care.

I understand that by agreeing to this WAIVER AND RELEASE, I, and on behalf of any minor dependants, agree to forever release the Released Parties from any claims towards loss of property, personal injury or death, as a consequence of my attendance to the Festival and participation in any activities or work, notwithstanding that such damage, loss or injury may have been caused solely or partly be the negligence of the Released Parties.

I understand and agree that I will not bring any weapons or illegal substances to the premises. I consent to any potential searches while onsite (including upon entry to the premises) for any prohibited items and the seizure of such items if found. I agree that the Released Parties are not responsible for any loss of personal property, damages or responsible for any stolen items while I am at the Festival.

In consideration for my participation in any program or attendance to the Festival, I, and/or on behalf of any minors, irrevocably and unconditionally agree to fully indemnify the Released Parties from and against any loss, liability, damages, costs and expenses suffered by the Released Parties as a result of a claim made or proceedings commenced by myself or my minors or by my heirs, representatives, assigns, against any other person, corporation or other entities related to the Released Parties. 

In the event I require medical attention, I will allow the Released Parties or medical professional to assist and this agreement extends to any liability arising out of or in any way connected with such medical treatment. I will bear all costs associated with any medical treatment necessary. I grant permission to the Festival organizers to use my likeness, voice, or statements captured in photographs, videos, or audio recordings taken during the Festival for promotional, advertising, or other purposes, without compensation or further notice to me.

I understand to failure to comply with all Festival rules, policies and instructions, or bringing weapons or illegal substances will result in my removal from the Festival without refund.

I declare that I have read, understood, and agree to the contents of this WAIVER AND RELEASE in its entirety. I also confirm that I am agreeing to this voluntarily. 

I hereby acknowledge that I have been advised of my right to obtain independent legal advice before agreeing to this WAIVER AND RELEASE and have voluntarily waived my right to obtain same.

By purchasing a ticket to the Festival, I assume all responsibility as set out herein.
